BATCHING CYCLE TIMETABLE The CON Batching Cycle Timetable has been updated and can be found on our website IMPORTANT INFORMATION REGARDING FILINGS 900 KAR 6:090, Section 2(1) states “The filing of documents…shall be made with the Office of Inspector General, Division of Certificate of Need, CHR Building, 5E-A, 275 East Main Street, Frankfort, Kentucky 40621 on or before 4:30 p.m. Eastern time on the due date.” 900 KAR 6:090, Section 2(2) now allows the filing of all documents electronically, however, when filing documents electronically, please note that the documents must be received by 4:30 p.m. in order to be filed timely. Please initiate the transmission of your electronic documents in ample time for them to be received by 4:30 p.m. Documents received after 4:30 p.m., even if you started sending them before 4:30 p.m., will be date stamped for the following business day. Further, all filings are to be made with the Division of Certificate of Need, not the Division of Administrative Hearings. The filings are date stamped and forwarded to the Division of Administrative Hearings. 1 IN-PERSON GOVERNMENT SERVICES With recent updates to the Centers for Disease Control (“CDC”) COVID-19 guidance for face coverings and physical distancing, and with the expiration of certain Commonwealth of Kentucky COVID-19 restrictions, please be advised that Executive Branch agencies will be implementing their post-COVID workforce plans. CHFS re-opened its public-facing offices to the public on June 11, 2021. For information about whether services will be provided remotely or in-person, please contact the particular office relevant to your inquiry. IN-PERSON FILING In the past, the Division of Certificate of Need allowed in-person filing of documents directly to our office. Moving forward, please note that recent regulation changes now allow electronic filing of all CON documents. In-person filing is still available, however, all in-person filing of documents shall be made at the guard’s desk in the CHFS building. CON staff will be called to receive and date stamp the filings. Your cooperation is appreciated. CERTIFICATE OF NEED HEARINGS Although Governor Beshear’s March 6, 2020 declaration of a State of Emergency in response to COVID-19 is no longer in effect, certificate of need hearings will continue to be conducted via teleconference due to limited availability of conference room space. Hearings on newly filed applications by cycle will not resume until the backlog of applications pending for hearing from 2020 and 2021 has been scheduled. It cannot yet be determined how long this will take. Hearings will be scheduled in approximately the order in which applications were filed. HSAHB will contact parties regarding scheduling in the approximate order that applications were placed on public notice. Please do not file motions concerning scheduling prior to being contacted by HSAHB.
