Regulations on Qualification Management of Construction Enterprises Decree No. 22 of the Ministry of Housing and Urban-Rural Construction of the People's Republic of China 2015January 22nd 2013 Chapter I General Provisions Article 1 In order to strengthen supervision and management of construction activities, safeguard public interests and standardize the order of construction market, ensure the quality and safety of construction projects and promote the healthy development of construction industry, laws such as the Construction Law of the People's Republic of China, the Administrative Licensing Law of the People's Republic of China, the Regulations on Quality Management of Construction Projects and the Regulations on Safety Production Management of Construction Projects are adopted.These Provisions shall be formulated in accordance with administrative regulations. Article 2 These Provisions shall apply for the qualification of construction enterprises within the territory of the People's Republic of China and implement the supervision and management of the quality of construction enterprises. The term "construction enterprises" as mentioned in these Provisions refers to enterprises engaged in construction activities such as new construction, expansion and reconstruction of civil engineering, construction engineering and installation of line and pipeline equipment. Article 3 An enterprise shall apply for the qualification of a construction enterprise in accordance with the conditions of its assets, main personnel, completed project performance and technical equipment. Only after passing the examination and obtaining the qualification certificate of a construction enterprise, can it engage in construction activities within the scope of the qualification permit. Article 4 The competent department of housing construction in urban and rural areas under the State Council shall be responsible for the unified supervision and management of the qualifications of construction enterprises throughout the country.The relevant departments of transportation, water conservancy and industrial informationization under the State Council cooperate with the competent departments of housing construction in urban and rural areas under the State Council to implement the management of the qualifications of construction enterprises of relevant qualification categories. The competent departments for housing construction in urban and rural areas of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the unified supervision and management of the qualifications of construction enterprises within their respective administrative areas.The relevant departments of transportation, water conservancy and communications of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government cooperate with the competent departments of urban and rural housing construction at the same level to implement the management of the qualifications of construction enterprises of the relevant qualification categories within their respective administrative areas. Article 5 The qualifications of construction enterprises are divided into three series: general contracting qualification, professional contracting qualification and construction service qualification. Construction general contracting qualification and professional contracting qualification are divided into several qualification categories according to the nature and technical characteristics of the project, and each qualification category is divided into several qualification levels according to the specified conditions.Construction service qualification is not classified and graded. Article 6 Qualification standards for construction enterprises and enterprises with corresponding qualifications may bear the specific scope of the project, which shall be formulated by the competent department of Housing Urban and rural construction under the State Council in conjunction with relevant departments under the State Council. Article 7 The State encourages enterprises with general contracting qualification to own wholly owned or controlled labor enterprises. Construction enterprises should strengthen technological innovation and personnel training, use advanced construction technology and building materials, and carry out green construction. Chapter
